• You are responsible for all activities that occur under your account
• One person or legal entity may not maintain more than one free account
• You must notify us immediately of any unauthorized use of your account

Acceptable Use

You agree not to use our services to:

• Violate any applicable laws or regulations
• Collect sensitive personal information without proper consent and safeguards
• Send spam, phishing attempts, or malicious content
• Impersonate others or misrepresent your affiliation
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our services

• Resell or redistribute our services without authorization

Survey Creator Responsibilities

As a survey creator, you are responsible for:

• Ensuring you have the right to contact survey participants
• Providing accurate information about survey purpose and data use
• Complying with applicable data protection laws (GDPR, CCPA, etc.)
• Maintaining confidentiality of respondent data as promised
• Not using responses in ways that harm or identify anonymous respondents

Intellectual Property

Our Property: The SeekWhy platform, including its design, code, features, and documentation, is owned by SeekWhy and protected by intellectual property laws.

Your Content: You retain ownership of survey content you create and data you collect. You grant us a license to use this content solely to provide and improve our services.

Payment Terms

• Paid plans are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by law
• We may change pricing with 30 days notice for existing customers
• Failure to pay may result in suspension or termination of your account
• You are responsible for any taxes applicable to your use of the service

Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications that temporarily affect availability. We will provide reasonable notice for planned downtime when possible.

Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be error-free, secure, or meet your specific requirements. AI-generated insights are provided as suggestions and should be reviewed before taking action.

Limitation of Liability

To the maximum extent permitted by law, SeekWhy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold harmless SeekWhy and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the service, your violation of these terms, or your violation of any rights of another party.

Termination

You may terminate your account at any time through your account settings. We may suspend or terminate your account if you violate these terms. Upon termination:

• Your right to use the service ceases immediately
• We may delete your data after a reasonable retention period
• Sections that by their nature should survive termination will remain in effect

Changes to Terms
